Legal terms governing your use of EventMaps

Important Notice for Event Organizers

If you create events on EventMaps, please pay special attention to Sections 6-9 regarding your responsibilities, liability, and indemnification obligations. By creating an event, you accept these terms in full.

1. Introduction

Welcome to EventMaps ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the EventMaps website and mobile application (the "Service") operated by Umit Hayim, trading as "EventMaps - Operated by Umit Hayim."

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

EventMaps is a platform that allows users to:

  • Discover local events through an interactive map interface
  • Create and manage events as an organizer
  • Purchase tickets to events listed on the platform
  • Join free events and connect with other attendees
  • Upload images and share event information
  • Filter events by category, location, and date

The Service includes payment processing for ticket sales, facilitated through our payment partner Stripe. EventMaps acts as a marketplace connecting event organizers with attendees.

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to create an account
  • One person may not maintain more than one account

3.2 Account Responsibilities

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. User Content and Conduct

4.1 Prohibited Content

You may not post content that:

  • Is illegal, harmful, or offensive
  • Infringes on intellectual property rights
  • Contains malware or malicious code
  • Promotes violence, discrimination, or illegal activities
  • Is spam or unsolicited commercial content
  • Contains false or misleading information

4.2 User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Harass, abuse, or harm other users
  • Create fake events or accounts

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Platform Role & Services

EventMaps operates as a marketplace platform, not as an event organizer.

6.1 What EventMaps Provides

  • A platform for event organizers to list and promote their events
  • Tools for attendees to discover, browse, and purchase tickets to events
  • Payment processing services through our partner Stripe
  • Communication tools between organizers and attendees
  • Maps and location-based event discovery

6.2 What EventMaps Does Not Do

  • We do not organize, host, or operate any events listed on the platform
  • We do not verify the identity of event organizers beyond basic account verification
  • We do not guarantee the quality, safety, or legality of any event
  • We do not pre-approve events before they are published
  • We are not responsible for the actions of event organizers or attendees

6.3 Attendee Acknowledgment

By using EventMaps to discover or purchase tickets to events, you acknowledge that you are entering into a transaction directly with the event organizer, not with EventMaps. You should use your own judgment when deciding to attend any event.

7. Event Organizer Responsibilities

7.1 Organizer Status

Event organizers may be individuals or legal entities. By creating paid events, organizers acknowledge that they are acting as independent sellers and are solely responsible for compliance with tax, consumer protection, and business registration requirements applicable in their jurisdiction. By creating an event on EventMaps, you ("Organizer") agree to the following responsibilities:

7.2 Event Accuracy

  • Provide accurate and complete information about your event, including date, time, location, and description
  • Only list events that you have the authority and capability to deliver
  • Update event information promptly if any details change
  • Use only images you have the right to use (your own photos or properly licensed images)

7.3 Legal Compliance

  • Ensure your event complies with all applicable local, national, and international laws
  • Obtain all necessary permits, licenses, and permissions for your event
  • Have proper authorization to use the event venue
  • Comply with health, safety, and accessibility requirements
  • Maintain appropriate insurance coverage for your event if required by law

7.4 Attendee Treatment

  • Honor all ticket purchases and commitments made to attendees
  • Respond to attendee inquiries in a timely manner
  • Treat all attendees with respect and provide a safe environment
  • Not discriminate against attendees based on protected characteristics

7.5 Tax Obligations

You are solely responsible for determining and fulfilling your tax obligations, including collecting, reporting, and remitting any applicable taxes (such as VAT, sales tax, or income tax) related to ticket sales and event income. EventMaps does not provide tax advice and is not responsible for your tax compliance.

8. Event Organizer Liability

Event organizers accept full liability for their events and all related claims.

8.1 Organizer Liability

As an event organizer, you are solely and fully liable for:

  • The organization, management, and execution of your event
  • The safety and wellbeing of attendees at your event
  • Any injuries, damages, or losses that occur at or in connection with your event
  • Any claims, disputes, or legal actions arising from your event
  • The accuracy of all information provided about your event
  • Refunds and compensation owed to attendees

8.2 EventMaps Liability Exclusion

EventMaps is not liable for any claims, damages, or losses arising from events listed on the platform, including but not limited to: event cancellations, event quality issues, personal injury, property damage, theft, fraud by organizers, or any other issues related to events. EventMaps's role is limited to providing the platform technology and payment processing services.

9. Indemnification

9.1 Organizer Indemnification

Event organizers agree to indemnify, defend, and hold harmless EventMaps, its owner (Umit Hayim), employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your event or any activities associated with it
  • Your breach of these Terms
  • Your violation of any applicable laws or regulations
  • Any claims by attendees or third parties related to your event
  • Any content you post or provide in connection with your event

9.2 User Indemnification

All users agree to indemnify EventMaps against claims arising from their use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Ticket Purchase Terms

10.1 Transaction Relationship

When you purchase a ticket through EventMaps, you are entering into a direct transaction with the event organizer. EventMaps facilitates this transaction but is not a party to the agreement between you and the organizer.

10.2 Attendee Acknowledgments

By purchasing a ticket, you acknowledge that:

  • The event organizer is solely responsible for delivering the event as described
  • EventMaps does not guarantee the quality, safety, or occurrence of any event
  • You attend events at your own risk
  • Refund requests are subject to the organizer's refund policy and our Refund Policy (Section 12)

10.3 Ticket Validity

Tickets are valid only for the specific event, date, and time indicated. Tickets may not be resold or transferred unless explicitly permitted by the event organizer. Duplicate or fraudulent tickets will be void.

11. Payment Terms & Fees

11.1 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By using our payment services, you also agree to Stripe's Terms of Service.

11.2 Service Fee (Buyers)

EventMaps charges buyers an 8% service fee on all paid ticket purchases. This fee is added to the ticket price at checkout and is displayed separately before payment. The service fee covers payment processing costs and platform services.

The service fee is non-refundable. In the event of a refund (including event cancellation), attendees receive the ticket price back, but the service fee is retained by EventMaps. The only exception is refunds due to EventMaps platform errors, in which case the full amount including service fee will be refunded.

11.3 Organizer Payouts

Organizers receive the full ticket price minus Stripe's payment processing fees (approximately 1.4% + €0.25 per transaction for European cards). EventMaps does not charge organizers any commission. Free events do not incur any fees.

All prices on EventMaps are displayed in Euros (€). Event organizers set their own ticket prices. EventMaps does not control or guarantee ticket pricing.

12. Refund Policy

12.1 Organizer Refund Policies

Event organizers may set their own refund policies for their events. These policies are displayed on the event page before purchase. By purchasing a ticket, you agree to the organizer's stated refund policy.

12.2 Mandatory Refund Situations (Significant Changes)

Regardless of the organizer's refund policy, attendees are entitled to request a refund if the event undergoes a "Significant Change." Significant Changes include:

  • Event cancellation: The event is cancelled entirely
  • Date change: The event date or time is changed by more than 24 hours from the originally advertised date/time
  • Venue change: The venue is moved to a location more than 3 kilometers from the original location
  • Main attraction removed: The main advertised performer, speaker, or attraction is removed from the event
  • Format change: The event changes from in-person to online-only format
  • Duration reduction: The event duration is reduced by more than 50%

12.3 Venue Change Notification

When a venue change occurs:

  • Changes more than 24 hours before the event: Attendees will be notified by email and may request a refund according to the organizer's policy
  • Changes within 24 hours of the event: Attendees will be notified by email and an automatic refund option will be made available to all ticket holders

12.4 Non-Significant Changes

The following are NOT considered Significant Changes and do not automatically entitle attendees to refunds:

  • Minor schedule adjustments (start time moved by less than 2 hours)
  • Addition of performers or activities
  • Weather-related venue change to a nearby location (within 3km)
  • Support acts or secondary features changing
  • Minor description updates that do not affect the core event

12.5 Refund Processing & Amounts

Refunds are processed through Stripe and typically take 5-10 business days to appear in your account.

When a refund is issued:

  • Ticket price: Refunded to the original payment method
  • Service fee (8%): Not refunded. The service fee is non-refundable as disclosed at checkout (see Section 11.2)
  • Exception: If the refund is due to an EventMaps platform error (not organizer action), the full amount including service fee will be refunded

12.6 Attendee-Requested Refunds

When an attendee requests a refund (outside of Significant Changes described in Section 12.2):

  • 7 or more days before the event: Attendees are entitled to a full refund, regardless of the organizer's stated refund policy
  • Less than 7 days before the event: Refunds are at the organizer's discretion, based on their stated refund policy displayed on the event page
  • No-show: Attendees who do not attend an event without prior cancellation are not entitled to a refund

To request a refund, contact the event organizer directly or submit a support request at support@eventmaps.io.

12.7 Event Cancellation by Organizers

Event organizers may cancel their events subject to the following conditions:

  • 48-hour minimum notice: Paid events with ticket sales cannot be cancelled within 48 hours of the event start time without EventMaps administrator approval
  • Automatic refunds: When a paid event is cancelled, full refunds are automatically initiated for all ticket holders
  • Attendee notification: All attendees will be notified via email when an event is cancelled
  • Cancellation within 48 hours: Organizers who need to cancel within 48 hours of the event must contact EventMaps support. Such cancellations require administrator review and approval

EventMaps reserves the right to restrict or suspend organizers who repeatedly cancel events, as this negatively impacts attendees and platform trust.

12.8 Technical Issues

If a payment or ticket issue occurs due to a technical problem on EventMaps' platform (not the organizer's fault), EventMaps will work with the affected parties to resolve the issue, which may include issuing refunds. Technical issues on the organizer's end (such as incorrect event details) are the organizer's responsibility.

13. Payout Terms

13.1 Payout Schedule

For event organizers with paid events, payouts are processed as follows:

  • Payouts are initiated 5 business days after the event ends
  • Funds are transferred to your connected Stripe account
  • Actual receipt of funds depends on your bank's processing time (typically 1-3 additional business days)

13.2 Payout Deductions

The following are deducted from your payout:

  • EventMaps platform commission (6% of ticket sales)
  • Stripe payment processing fees
  • Any refunds issued to attendees
  • Any chargebacks or disputes

13.3 Payout Requirements

To receive payouts, you must complete Stripe's identity verification and connect a valid bank account. EventMaps reserves the right to withhold payouts if there are pending disputes, suspected fraud, or violations of these Terms.

14. Content Moderation

14.1 No Pre-Approval

EventMaps does not pre-approve or verify events before they are published. Events created by organizers are published immediately upon submission. While we employ automated systems to detect potentially problematic content, we cannot guarantee that all inappropriate content will be caught.

14.2 Our Rights

EventMaps reserves the right to, at any time and without prior notice:

  • Remove, disable, or restrict access to any event or content that violates these Terms or our Community Guidelines
  • Suspend or terminate organizer accounts for violations
  • Refuse to process payments for events we deem high-risk or potentially fraudulent
  • Cooperate with law enforcement or regulatory authorities

14.3 Reporting

Users can report events or content that violate our guidelines using the "Report Event" feature on any event page. We review all reports and take appropriate action, typically within 24-48 hours.

15. Dispute Resolution

15.1 Disputes Between Attendees and Organizers

EventMaps encourages attendees and organizers to resolve disputes directly. If you have an issue with an event:

  • First, contact the event organizer directly through the platform
  • If unresolved, you may contact EventMaps at support@eventmaps.io for assistance
  • EventMaps may, at its sole discretion, mediate disputes but is not obligated to do so

15.2 Payment Disputes and Chargebacks

If you believe a charge is unauthorized or incorrect, please contact us before initiating a chargeback with your bank. Chargebacks can result in:

  • Delays in resolution
  • Additional fees charged to the organizer
  • Potential suspension of organizer accounts for excessive chargebacks

15.3 Disputes with EventMaps

For disputes with EventMaps directly, please contact us at support@eventmaps.io. We aim to respond to all inquiries within 5 business days.

16. Limitation of Liability

16.1 General Limitation

To the maximum extent permitted by law, EventMaps and its owner (Umit Hayim) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or goodwill
  • Personal injury or property damage at events
  • Actions or omissions of event organizers or other users
  • Service interruptions or technical issues

16.2 Maximum Liability

Our total liability for any claims arising from your use of the Service shall not exceed the greater of:

  • €100, or
  • The total amount you paid to EventMaps in the 12 months preceding the claim

16.3 Event-Specific Disclaimer

EventMaps is a platform provider and is not responsible for events listed on the Service. We do not guarantee that events will occur as described, that organizers are legitimate, or that events are safe or legal. Users attend events at their own risk.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or your use of the Service will be resolved exclusively in the courts of Barcelona, Spain.

If you are a consumer in the European Union, you may also have rights under the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
